National Unity Platform(NUP) Chief Mobilizer, who is also an elder brother to Robert Kyagulanyi Ssentamu alias Bobi Wine has set 14 witnesses to testify against Kampala Central member of parliament Muhammad Nsereko over vote rigging.
Nyanzi, through his legal team led by Justine Ssemuyaba told High Court Civil Division Judge Jesse Byaruhanga that the 14 witnesses will include the petitioner himself and his campaign agents who witnessed the accused person, his agents and officers from Justice Simon Mugenyi Byamukama’s Electoral Commission committing electoral crimes against their client.
At the scheduling proceedings, it was agreed that Nyanzi will be the first in the dock to be grilled by Nsereko’s lawyers, he will be followed by his other witnesses led by his sister Saudah Nsereko. This will take place on 17th November 2022.
Electoral Commission lawyers led by Eric Sabiiti told Court that they will also produce 8 witnesses who will rubbish Nyanzi’s claims against the institution. Nsereko’s lawyers told the Court that their client will be the only person to testify.
Nyanzi first petitioned Mengo Chief Magistrate Court seeking for a recount of voters, an application which was dismissed with costs and was ordered to pay Shs35m. He petitioned the High Court but his matter was dismissed with cost by Margret Apiny on grounds of failing to serve the defendant in person. He appealed the ruling.
Three justices of the Court of Appeal led by Justice Geoffrey Kiryabwire, Justice Stephen Musota and Justice Christopher Madrama ordered for a retrial of the petition at the High Court explaining that the appellant made all the necessary efforts to serve the defendant who went into hiding which resulted into the dismissal of his entire petition at the High Court.
The judge directed that the matter be allocated to another judge who has to hear it afresh on its merit.
Nyanzi claims that the defendants committed a lot of electoral crimes including vote rigging and he wants Court to declare him the winner of the 2021 Kampala Central parliamentary seat
